Object and Scope of Application

This document describes the general purchasing conditions (hereinafter, the “General Conditions” or the “Contract”) to which the commercial transactions carried out between Cala by Lilian and the purchaser (hereinafter, the “Client”) are subject. ), which are considered accepted in their entirety and the parties are obliged to comply completely at the time of formalizing the purchase of the products offered through this Website.

These Conditions may be modified without prior notice, without prejudice to the fact that each sale will be governed at all times by the general contract conditions that were published at the time of formalization of the sale.

Cala by Lilian reserves the right to cancel a client's access account if fraudulent, speculative or bad faith acts are detected in the use of the service, non-compliance with these General Conditions.

Commercial terms

Cala by Lilian may, at any time, modify the existing commercial offer on the Website, both with regard to products and prices, promotions and commercial and service conditions.

It is the intention of Cala by Lilian that the information about the products and the commercial purchasing conditions offered on the Website are accurate at all times and are current while they are published in said medium. However, exceptionally, there could be an accidental error in said information, beyond the control of Cala by Lilian.

In case of error, the purchased product may be returned free of charge within the same period established in these general conditions for the return of defective products.

Right of Withdrawal

The Client will have the right to cancel the purchase made, without the need to plead or give an explanation in this regard, within fourteen (14) calendar days following receipt of the product by the Client, without suffering a penalty. some.

The Client may return any product as long as it has not been opened or used and retains its original seal or packaging.

To exercise this right of withdrawal, the Client must notify Cala by Lilian of their intention to withdraw from the formalized contract through an unequivocal statement that must be made by sending an email to the address: calabylilian@gmail.com . In said email you must communicate that you are exercising your right of withdrawal, indicating in the order reference code, your name and shipping address, as well as the date on which the purchase was formalized.

The orders must be returned by the Client to Cala by Lilian, with the CLIENT being obliged to bear the costs that such return causes. The return period for this case may not exceed fourteen (14) days from the date the withdrawal was communicated.

In the event that the Client decides to exercise this right, the refund of the price paid will be made within thirty (30) days from the moment the withdrawal was communicated and through the same procedure that was used in the purchase process.

In the event of non-compliance with any of the general conditions for the exercise of the right of withdrawal, CALA BY LILIAN may withhold the reimbursement of the amounts due, and in any case, it will retain them until it has received the products subject to withdrawal in the same conditions in which were sent.

All returns must be made with the original packaging and care must be taken not to damage the product. In the event that the customer is responsible for the return and the product or package arrives damaged, broken or damaged, the customer will be responsible for covering the repair costs. and claim to your transport company. In this case, Cala by Lilian will provide you with an invoice for the repair so that you can request said claim from those responsible.

Prices

The total price of the products will appear indicated in the description of each product on the Website. The prices offered include the price of the product, taxes derived from the purchase and any other amounts inherent to the sale, therefore reflecting the total and final price of the product.

Preparation and Shipping Times

Preparation Time – The time needed to prepare an order may vary. Consult each article for more information in the information banner at the top of the main page.

The purchased products will be delivered to the address indicated by the client by the Nacex or DHL courier service, unless another method has been previously agreed with the client. The client undertakes that the delivery of the order can be delivered within the usual merchandise delivery schedule.

In the event that the delivery suffers a delay for reasons attributable to the Client, or due to the latter's unjustified rejection upon receipt, Cala by Lilian will be obliged to carry out one or both of the following actions (without affecting to any other right or resource that is in the hands of Lilian Urquieta):

1. Charge the Customer for the costs of storage or return of the product and any other reasonable cost or expense that may arise.
2. Terminate the Contract immediately. In such case, the Client must face the expenses arising as a result of non-compliance with this Contract. If the product has already been paid, the difference between the amount charged and the reasonable administrative expenses that have arisen will be entered by the same means in which it was paid. If they have not been paid, said expenses will be claimed from the Clients.

Customs duties and tariffs: International customers will be responsible for paying applicable customs duties and duties. Lilian Urquieta is not responsible for delays due to customs procedures.

Exchange and Return Policy

1. Due to the nature of these items, exchanges or returns of headdresses or other personalized accessories WILL NOT BE ACCEPTED .

2. However, if once the order is received it is found damaged, you must contact us within 24 hours. In the event that the customer receives a product that he considers defective , he will notify Cala by Lilian by telephone or by email at, referring to the following information regarding the product:

• Reasonably detailed explanation of the defects or damages that the product presents, providing photos.
• Delivery note number and other order information that may be reasonably useful.

So that Cala by Lilian can check the status of the product, the Client will send it within a period of no more than five (5) days from receipt of the product. If Cala by Lilian confirms that the product is defective, it will proceed, as appropriate, to repair or replace the product, bearing the costs of return and resending. In the event that the product is not defective, the Customer must bear all the costs that the claim could have caused, both shipping and return costs.

3. For returns of orders that are not personalized , the buyer must notify Cala by Lilian, by telephone or email, of their intention to return the product within a period of no more than five (5) days from receipt of the product. The buyer will send the product within a period of no more than seven (7) days from receipt of the product. Return shipping costs will be borne by the buyer . If the item is not returned in its original condition, the buyer will be responsible for any loss in value.

Commitment to the Making and Purchase of Personalized Headdresses

Evidence

Lilian offers the possibility of making 1 appointment, both in person and virtually. If at the end of the second trial the client requests the creation of another headdress, it will have an extra cost of 50% of the final price of the headdress.

Confirmation and Deposit

Once the design has been decided and budgeted, it is necessary to provide a deposit of €50 to confirm the reservation with Lilian. The deposit can be made in cash or card at the Atelier or by bank transfer or Paypal.

Annulment

The client has a period of 24 hours from making the deposit payment to cancel the order. If the cancellation is made before 24 hours, 100% of the deposit received will be returned. No deposit refunds will be made after this period.

Terms and Payments for Custom Orders

Payments can be made in cash or card in our Atelier, by bank transfer, Bizum or Paypal. The deadline for completing the order will depend on the type of accessory, but any piece made to order will have a minimum processing period of between 10 and 20 days. In any case, you will be informed in advance of the estimated completion time in your specific case.

Once the order is completed, shipments will be made via express courier (24-48 hours) for peninsular destinations, or certified mail for shipments to Islands, Ceuta, Melilla or international destinations. Shipping costs, both for the tests and the finished order, will be borne by the client.

Intellectual property

All products offered by Lilian Urquieta and, especially, its designs, brands or industrial drawings and any other signs susceptible to industrial and commercial use are subject to intellectual and industrial property rights of Lilian Urquieta or third-party owners who have duly authorized them. its inclusion on the Website.

In no case will it be understood that, by means of this Contract, any license is granted in favor of the Client in matters of intellectual or industrial property, or that said rights are waived, transmitted, totally or partially assigned. Nor will it be understood as conferred any right or expectation of right over the intellectual or industrial property of Lilian Urquieta or third parties. In particular, any alteration, exploitation, reproduction, distribution or public communication of any content that may be protected by intellectual and industrial property rights to which the Client may have access through the Website, or by its relationship with Lilian Urquieta, without the prior express authorization of Lilian Urquieta or third parties holders of said rights.

Integrity and Assignments of the Contract

The total or partial nullity, current or subsequent, of any of the clauses of these Conditions will not entail the nullity of the rest of the clauses, which will remain fully valid if they do not suffer from said defect. In such cases, the void clause will be replaced by an equivalent one.

The Client may not transfer the position acquired through the acceptance of these Conditions to third parties, nor the rights and obligations consequent upon the acquisition of products through this Website without the express written consent of Lilian Urquieta.

Lilian Urquieta may transmit, assign, encumber, subcontract or otherwise transfer a contract or any of the rights or obligations derived from it, at any time during its validity. For the avoidance of doubt, such transmissions, assignments, liens or other transfers will not affect the rights that, where applicable, the Client, as a consumer, has recognized by law nor will they nullify, reduce or limit in any other way the guarantees, both express and tacit provisions, which could have been granted to the Client.

Resolution of the General Purchase Conditions

These General Conditions may be terminated, in addition to the causes expressly established by the applicable legal system, expressly for the following:

1. Mutual agreement of the parties.
2. Lack of the agreed payment, taxes included, or shipping costs, if payment corresponds to the Client.
3. Causes of Force Majeure do not cease within a period of more than 2 business days.
4. Failure by the Client to comply with the General Conditions.

Complete Agreement

These General Conditions and any document expressly referred to in them constitute the entire agreement between Lilian Urquieta and the Client in relation to the subject matter thereof and replace any other pact, agreement or previous promise agreed upon between Lilian Urquieta. and the Client verbally or in writing.

The conclusion of the Contract is carried out without having relied on any statement or promise made by the other party or that could be inferred from any statement or writing in the negotiations entered into by both before it, except for that which is expressly mentioned in these General Conditions. .

Right to Modify Conditions

Lilian Urquieta reserves the right to modify these General Conditions. The modifications introduced will not be applied retroactively.
